If someone is arrested for drug possession, they could face incarceration, fines and other punishments depending on the severity of the charge. Criminal drug possession can vary depending on several factors. One of the biggest factors that affect drug possession cases is drug schedules.
If you are facing drug possession charges, it can help to learn more about drug schedules. Here is what you should know:
What are drug schedules?
The management of substances is decided by the Controlled Substance Act (CSA). The CSA categorizes drugs into five different schedules based on their tendency to cause abuse. Who can possess, manufacture and distribute substances depends on a drug’s schedule. The five different drug schedules include:
- Schedule V: Drugs with the lowest risk of abuse. These drugs can be found in many stores and bought over the counter, such as cough medicine.
- Schedule IV: Drugs with a slightly higher risk of abuse. These drugs often require a doctor’s prescription to obtain and use, such as tramadol or diazepam.
- Schedule III: Drugs with a moderate risk of abuse. These drugs, such as testosterone and ketamine, are often only used in medical fields with some availability with a prescription.
- Schedule II: Drugs with a high risk of abuse. These drugs have almost no medical uses, including morphine and fentanyl.
- Schedule I: Drugs with the most severe risk of abuse. These drugs, such as heroin or peyote, have no medical uses and the highest restriction.
Criminal charges can vary greatly between the possession of a Schedule V substance and a Schedule I substance. Legal guidance can help you assess the severity of your case and build a strong defense.
